Two Dayton-area advocacy organizations have filed a federal lawsuit claiming the location of the Dayton Mall's public bus stop discriminates against people with disabilities. Advocates for Basic Legal Equality and Disability Rights Ohio filed suit against the owner, Columbus-based WP Glimcher Incorporated, as well as the mall's Macy's, Sears and Elder Beerman anchor stores. They say the bus stop is unreasonably far from the mall's main entrance, creating barriers for people with disabilities. Disability Rights Ohio attorney Jason Boylan says the Americans with Disabilities Act was intended to prevent situations like this.
The groups say they've worked to find a solution since April. Glimcher has said it has talked to the Regional Transit Authority about solutions for the bus stop location, but was not able to agree on the details. The lawsuit filed on behalf of four Dayton-area residents asks the court to require the mall to allow buses to stop at its entrances.
