Judge Allows Waters' Discrimination Lawsuit Against OSU To Proceed

A federal district judge has ruled fired Ohio State University marching band director Jon Waters' lawsuit against the school may proceed. Judge James Graham denied Ohio State's request to dismiss the civil rights lawsuit. The suit accuses the university, President Michael Drake and a provost of discrimination. Waters claims they denied him due process and disciplined him differently than a female employee. Graham ruled the university did not violate Waters' due process rights but says the suit may proceed on the grounds of reverse discrimination. Waters was fired last summer after an internal investigation found that he turned a blind eye to what the school described as the band's "sexualized culture."
