Judge Rules Against Ohio Libertarian Ballot Access Lawsuit

www.ohsd.uscourts.gov

A federal district judge has delivered a legal victory to Republican Ohio Secretary of State Jon Husted and a voter sued by Libertarians for their roles in disqualifying the party's gubernatorial candidate from the fall 2014 ballot.  The Libertarian Party of Ohio sued Husted and voter Greg Felsoci, alleging they conspired to selectively enforce Ohio election law to help Republican Governor John Kasich's re-election bid. The lawsuit alleged violations of the First Amendment and the Equal Protection Clause of the U.S. Constitution.  Judge Michael Watson says the party failed to prove any conspiracy when Husted disqualified Libertarian gubernatorial candidate Charlie Earl for petition violations.
