A federal appeals court panel has ruled that a northeastern Ohio nursing home was liable for the death of one of its residents after giving her diabetes medication she didn't need. In its ruling today, a three-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati denied The Landing of Canton's appeal of a jury's decision finding them liable for Dorothy Freudeman's death. Freudeman was found unresponsive in 2007 after it's believed she was inappropriately given diabetes medication, causing brain dysfunction, diminished quality of life, and ultimately, death. The judges wrote that evidence at trial showed that the home "consciously disregarded the rights and safety of its patients with a great probability of causing substantial harm."
