Columbus, OH – Ohio death row inmate is asking a federal judge for an emergency delay of next week's scheduled execution. Kenneth Biros says the state is rushing too fast to use its new one-drug lethal injection process. He says the untested method announced last month could constitute cruel and unsual punishment. The state opposes any delay, and says the one-drug method should end a five-year-old lawsuit in Ohio claiming injection can cause inmates severe suffering. Governor Ted Stickland yesterday denied Biros' request for clemency. Ohio Public Radio's Jo Ingles reports.
