Ohio State Wants Fired Band Director's Lawsuit Thrown Out

Attorneys for Ohio State University say fired marching band director Jon Waters has no legal grounds to proceed with his defamation suit. 

The University is asking the Ohio Court of Claims to dismiss the suit. Waters was fired in July2014  after an internal investigation determined he ignored a "sexualized culture" within the band. University attorneys argue most of the investigative report's details weren't about Waters, but about band culture. They also say Waters acknowledges "the university's conclusions about the band were true." Their brief also cites a federal judge's April ruling in a separate civil rights suit that the university did not violate Waters' due process rights. Waters' discrimination claim in that case is proceeding.
