The Ohio Supreme Court has upheld a 42-million dollar penalty against Columbus-based American Electric Power for earning excessive profits.
Justices sided with state regulators, who ordered AEP to repay the money to its customers in 2009. The court says a law that gives regulators a right to determine excessive profits is constitutional, and rejected company arguments that the law is too vague.
